Lasting Power of Attorney

Power of Attorney

There are two types of Lasting Powers of Attorney (LPA).  A Property and Financial Affairs Power of Attorney which allows an individual to handle your finances, as well as taking care of the upkeep of any properties that you may have.

In contrast, a Health and Welfare Power of Attorney allows your appointed attorney to make decisions about health and care arrangements.

Lasting Power of Attorney can only be granted if a person is deemed to be ‘of sound mind’ when appointing someone to look after their affairs.

Lasting Powers of Attorney were created in English law in 2005 and came into force on the 1st October 2007, (replacing the previous ‘enduring powers of attorney).  LPA is a legal document, which provides another person the authority to act on  behalf  of an individual in the event of that person becoming  physically or mentally impaired, such that they are no longer able to deal with their own affairs.
